These Terms and Conditions are the standard terms which apply to the provision of driving tuition by Joycelyn Driving School to students
that require such tuition.

Definitions:
Instructor / I / Me / My / themself refers to Joycelyn of Joycelyn Driving School You / Your / Yourself refers to student receiving driving lessons. DVSA refers to Driving & Vehicle Standards Agency. Parent / Guardian refers to individual legally responsible for student

1 COVID – 19

Keeping Safe.

1.1  The DVSA has lifted COVID-19 Restrictions for driving tests.

1.2  Face masks will now be a personal choice for driving lessons and driving tests.

1.3  You no longer have to self isolate if you have COVID-19, however I recommend you reschedule your driving lesson to prevent the spread of the virus.

1.4  If you have a driving test and test positive for COVID-19, see the Gov.uk website for their current guidelines.

2 Driving Instructor

2.1 I am registered with the DVSA as an Approved Driving Instructor (ADI) and My ADI registration is up to date. I shall display My current DVSA ADI registration certificate in any vehicle that I use for a lesson, and I will ensure that that ADI certificate is kept up to date at all times.

3 Driving Lessons

3.1  Each lesson will be tailored to your needs, with mutally agreed goals for the lesson and progress marked on your progress report.

3.2  No other person will be in the car with you during your lessons.

3.3  In case of bad weather the instructor will put safety first and decide whether the lessons will take place.

3.4  A lesson may need to be rearranged to accommodate a student taking their driving test. If this happens, you will be given ample notice.

3.5  You will be able to view up and coming lessons via the MyDriveTime App for students which you will be required to download once you receive the SMS link to the app. NB: Please use the link when downloading the App and follow the instructions.

4 Lesson Cancellation

4.1  You may cancel a lesson without charge if You give the instructor at least 48hrs prior notice of the cancellation.

4.2  If you cancel a lesson due to illness you will still incur any late cancellation fee.

4.3  A lesson maybe cancelled to accommodate another student taking thier driving test. If this happens you will be given ample notice.

4.4  The instructor may cancel the lesson due to illness, unavailability of a suitable vehicle or the instructor is not available or able to provide the lesson fully or properly. In such circumstances, if the lesson is cancelled You will not be charged for the lesson.

4.5 The instructor may cancel the lesson if the instructor has reason to believe that You are not fit to drive at the time of the lesson due to any factors including, but not limited to, alcohol, drugs (whether prescribed or otherwise), illness or other medical condition. If the instructor cancels the lesson for such reason you will be charged for the lesson.

5 Payment & Fees

5.1  Lesson bookings will only be secure once payment has been received.

5.2  The number of lessons booked will be based on the number of prepaid hours.

5.3  There are no refunds for the first 10hrs or where there are only 5 lessons left in credit.

5.4  Any credits are not-refundable if lessons have ceased for a period of six months or more or fall into clause 5.3 above.

5.5  You will be notified of any price increase. Any price increase will take immediate effect. This means You will be subject to the price increase when Your next payment is due.

5.6  Payment Method will be by bank transfer. Payment details will be sent to You via email.

6 Your Obligations

6.1  You must hold a valid UK driving licence (either provisional or full);

6.2  You must bring Your driving licence with you during all your lessons.

6.3  If You have been banned from driving and are training for a retest, You must be legally entitled to take tuition and must present proof to the instructor of that entitlement;

6.4  You must demonstrate Your ability to read a number plate from the distance specified in the Highway Code;

6.5  You must always wear any relevant prescribed glasses or contact lenses; if required for driving.

6.6  You must inform the instructor of any medical conditions or prescribed medication which may affect Your driving ability.

6.7  If You fail to comply with one or more of sub-Clauses 6.1 to 6.6 above the instructor may immediately cancel one or more lessons. If this happens You may still be charged for the cancelled lessons.

7 Vehicle Safety & Insurance

7.1 The tuition vehicle provide is fitted with dual controls, are fully roadworthy, taxed, have a valid MOT (where relevant), and are
fully insured for the purposes of driving instruction.

8 Driving Tests

8.1 The instructor shall discuss driving tests with You and inform You when You are ready to take a test;

8.2  Final test readiness is the instructors decision and is not negotiable.

8.3  Assessment to test readiness is not a guarantee of a test pass.

8.4  You shall be responsible for booking theory and practical tests. It shall be Your responsibility to check the details of the test on Your DVSA confirmation letter.

8.5  The instructor will advise You which test centre to book Your practical driving test.

8.6  Before you book an available practical test slot, You must check with the instructor to ensure the instructor and instructor’s vehicle will be available for the test prior to booking the test slot.

8.7  You may use the instructor’s vehicle for Your test only if the instructor deems You are ready to take Your driving test.

8.8  When You attend a test, You must take all required documentation with You. If You do not, Your test may be cancelled and You would then lose Your test fees;

8.9  If you test positive for COVID-19, see the Gov.uk website for their current guidelines.

8.10  If Your test is cancelled by the DVSA giving You insufficient time to provide instructor with the required cancellation notice of a booking, You must still pay the instructors fees for instructors time and/or the use of instructors vehicle. In that case, the instructor shall advise You on claiming compensation from the DVSA for the cost of those fees.

9 Termination

9.1  It is the instructor’s discretion to terminate Your tuition if You fail to conduct Yourself in a reasonable manner.

9.2  You may terminate Your tuition if You feel that the instructor has not conducted themself in a reasonable or professional manner.

9.3  Monies will be refunded to You for lessons not yet taken. You will still be charged for a lesson if You terminate less than 48hrs prior to that lesson. NB: There are no refunds for the first 10hrs or where there are only 5 lessons left in credit.

10 Changes to Terms & Conditions

10.1 Change to Terms and Conditions may occur without giving You notice, however You will be informed as soon as is reasonably possible of any such changes.

11 Your Personal Information (Data Protection)

11.1  All personal information collected will be processed and held in accordance with the provisions of EU Regulation 2016/679 General Data Protection Regulation (“GDPR”) and Your rights under the GDPR.

12 Complaints

12.1 I always welcome feedback from My Students and, whilst I always use all reasonable endeavours to ensure that I provide a high standard of tuition and service to Students, I nevertheless want to hear from You if You have any cause for complaint. If You have any complaint about My tuition or other services or any other complaint about Me, please raise the matter with Me in person.
